flux.study

Terms of service

These terms are current as of today. If anything here changes in a way that affects you, we will tell you before it takes effect.

Who you are agreeing with

flux.study is operated by Clear Success Ltd (company number 13984815), registered in England and Wales at 5 Clark Close, Shipston on Stour, CV36 4HJ. In these terms, “we” and “us” mean Clear Success Ltd, and “flux.study” means the website and the tutor your child uses.

This agreement is between us and you, the parent or guardian. It is not an agreement with your child. You need to be 18 or over, and you need parental responsibility for the child whose profile you create. Your child uses flux.study under your account and your supervision, and you are responsible for what happens on it.

What flux.study is, and what it is not

flux.study gives your child a tutor they can talk to, sets them work, marks it, and shows you what they have been doing.

The tutor is artificial intelligence. Everything it says, every lesson it sets and every explanation it gives is generated by a computer program, not written or checked in advance by a teacher. It can be wrong. It can be confidently wrong. We think it is good, and we check it for safety before your child sees it, but it is not a teacher and we do not present it as one.

flux.study is not a school, not a tutor you have met, and not a substitute for either. It does not assess or diagnose special educational needs, and it is not a health or psychological service. If you think your child needs that kind of help, please speak to their school or your GP.

We are a new and small service and we are still building it. Parts of it will change, and sometimes it will be unavailable. We do not promise it will always be working.

Accounts, and your child’s sign-in

You create the account with your email address. Your child signs in with a username and a PIN that you set — they do not need an email address, and they cannot create an account themselves.

Keep your own password and your child’s PIN to yourself. Anything done through your account, or your child’s sign-in, is treated as done by you. Tell us as soon as you can if you think someone else has got in.

An account is for one household and the children in it. Please do not share it outside your family.

What you and your child agree not to do

Using flux.study, you agree that neither you nor your child will:

  • try to get the tutor to produce sexual, violent, hateful or otherwise harmful material
  • use it to bully, threaten or impersonate anyone
  • try to get around the safety checks, the age settings, or your child’s sign-in
  • try to break into, overload, copy or reverse-engineer the service
  • use it for anything unlawful
  • resell it or pass it off as your own service

If this happens we may limit what the account can do, suspend it, or close it. Where a child’s safety is involved we will act first and explain afterwards.

Safety comes before everything else here

Every message your child sends and every reply the tutor gives is checked before it is shown. If something suggests your child may be at risk, the conversation is flagged and a member of our team reads it.

Depending on what it is, we may contact you, and in circumstances the law requires we may contact the authorities. We may also suspend a conversation or an account straight away.

Where we have acted because of a safeguarding concern, that decision is not a customer-service decision and we may not be able to discuss the details with you, including where doing so could put a child at risk. You can always ask us to explain what we are able to explain.

You agree to tell us if you believe your child is at risk, and not to use flux.study as a way of reporting an emergency. If a child is in immediate danger, call 999.

Paying for flux.study

flux.study is not open for public subscriptions yet. We are opening it to a small number of founding families first, by invitation. If you are using it now, you are one of them.

When subscriptions open, the plans will be the ones shown on our pricing page, and nothing else. We will set out here, before you are asked to pay anything, exactly what a plan costs, what it includes, how it renews and how to cancel it.

We will not charge you without telling you first. You will not be charged anything you have not agreed to, and if a payment is ever taken in error we will refund it.

When you do buy a subscription, you will have the cancellation rights the law gives you as a consumer, including the right to change your mind within 14 days of buying a digital service — and nothing in these terms takes those rights away.

Payments are handled by Stripe. Your card details go to Stripe and are not stored by us. Our privacy policy explains what Stripe receives.

What we are and are not responsible for

Nothing in these terms limits our responsibility for death or personal injury caused by our negligence, for fraud, or for anything else the law does not allow us to limit. Your statutory rights as a consumer are not affected by anything here.

Beyond that, we are responsible for loss we cause by failing to take reasonable care, but not for things outside our reasonable control, and not for losses that were not foreseeable when you started using flux.study.

We do not promise particular results. The tutor is a teaching tool, and how your child does at school depends on far more than the time they spend here. Please do not rely on the tutor as the only check on a piece of work, and do not treat what it says as a substitute for advice from their school.

Ending this agreement

You can stop using flux.study and close your account whenever you like. Our privacy policy explains what happens to your child’s data when you do, and how to ask us to delete it.

We may end this agreement, or close an account, if these terms are broken, if we have a safeguarding concern, or if we stop offering the service. Except where a child’s safety means we have to act immediately, we will give you reasonable notice and explain why.

If we ever stop running flux.study, we will tell you in advance, give you a way to get a copy of your child’s work, and refund anything you have paid for a period you will not get.

If we change these terms

We may change these terms — for example when subscriptions open, or when something about the service changes. If a change affects you in a way that matters, we will email you before it takes effect. The date at the top of this page shows when it last changed.

If you do not agree to a change, you can close your account. Carrying on using flux.study after a change takes effect means you accept it.

Which law applies

These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you live in Scotland or Northern Ireland, you can also bring proceedings in your own courts.

Getting in touch, and complaining

Write to support@flux.study. We will reply within one month, and usually much sooner.

If we have not put something right, tell us and we will try again. If your complaint is about how we have handled information about you or your child, you can also complain to the Information Commissioner’s Office at ico.org.uk.
